Terms of use

1. Agreement and operator

These Terms of Use (“Terms”) are a binding agreement between you and Quinn Cho, a sole proprietor based in British Columbia, Canada, who operates Rally (“Rally,” “we,” “us,” or “our”). They govern the Rally mobile application, letsrally.ca, activity invitations, and related services (collectively, the “Service”).

By creating an account or affirmatively accepting these Terms, you confirm that you have read and agree to them and to the Community Guidelines. Our Privacy Policy explains our handling of personal information.

2. Eligibility

You may use Rally only if:

• You are at least 19 years old.
• You can legally enter into this agreement.
• You provide accurate information and use the Service lawfully.
• You have not been banned unless Rally gives written permission to return.

We may request reasonable evidence of age or eligibility and restrict accounts that do not qualify.

3. What Rally does—and does not do

Rally provides technology that helps adults discover one another, publish plans, join plans, and communicate. Plans and in-person interactions are independently created, arranged, and undertaken by members.

Rally does not organize, host, guide, lead, supervise, inspect, certify, approve, endorse, provide transportation for, or control any member-created plan or in-person interaction. A member who creates a plan is a “Plan Creator,” not Rally’s employee, contractor, representative, partner, or agent. Other participants are also independent users.

Rally does not perform criminal background checks and does not guarantee a member’s identity, age, qualifications, experience, intentions, conduct, attendance, suitability, or safety. Profile information and plan descriptions are supplied by members.

4. Accounts

You must provide accurate account information, keep access to your email secure, and promptly notify us of suspected unauthorized access. You are responsible for activity occurring through your account. You may not transfer, sell, lend, automate, or create multiple accounts to evade restrictions.

5. Independent decisions and in-person risk

Meeting people and participating in outdoor, sporting, or recreational activities can involve known and unknown risks, including personal injury, illness, death, property damage or loss, terrain, weather, water, traffic, wildlife, remoteness, equipment, physical exertion, transportation, venues, and the conduct of other people.

You voluntarily decide whether to meet another member or participate in a plan. You are responsible for assessing the people, route, conditions, difficulty, equipment, transportation, venue, permits, insurance, and emergency needs; staying within your abilities; and leaving when you feel unsafe. Review the Safety Centre before meeting.

6. Plan Creators

If you create a plan, you must describe it honestly, disclose material difficulty or hazards you know about, avoid presenting yourself as a qualified guide unless that is accurate and lawful, comply with applicable laws and venue rules, and communicate material changes. You may not state or imply that Rally operates, approves, insures, or supervises your plan.

7. Community conduct

You must follow the Community Guidelines online and in conduct connected to people you meet through Rally. Prohibited conduct includes harassment, threats, stalking, hate, discrimination, coercion, sexual misconduct, impersonation, scams, spam, illegal conduct, privacy violations, dangerous deception, and exploitation.

Rally is for social and activity connections and is not a dating service. Do not use it primarily to pursue romantic or sexual contact, and always respect boundaries and consent.

8. Your content

“User Content” includes profiles, photos, plan information, messages, reports, and other material you submit. You retain ownership of your User Content. You represent that you have the rights and permissions needed to submit it and that it does not violate law, privacy, intellectual property, or these Terms.

You grant Rally a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, adapt for technical display, transmit, and display your User Content only as reasonably needed to operate, secure, moderate, improve, and promote the Service. This licence ends when the content is deleted, except for restricted safety evidence, technical backups, content shared by others, or material we must retain as described in the Privacy Policy.

9. Reporting, blocking, and moderation

Rally provides tools to report profiles, photos, plans, covers, and messages and to block members. We aim to review ordinary reports within 5–7 business days and prioritize credible urgent safety reports, but timing may vary with severity, information, and volume. Rally is not an emergency service; call 911 for immediate danger.

We may preserve relevant evidence, review reported content, request information, remove or restore content, restrict features, warn users, suspend accounts, ban accounts, or refer matters to authorities where appropriate. To protect privacy and safety, we may not disclose every investigative detail. You may ask for review of an enforcement decision by contacting support.

10. Intellectual property and permitted use

Rally and its software, branding, designs, text, and non-user content are owned by or licensed to Rally. Subject to these Terms, we grant you a limited, personal, non-transferable, revocable licence to use the Service for its intended non-commercial purpose. You may not scrape, reverse engineer, disrupt, probe, copy, resell, automate, or exploit the Service except where law expressly permits.

11. Third-party services

The Service may use or link to third-party services, maps, venues, websites, or content. Rally does not control those parties and is not responsible for their availability, conduct, terms, privacy practices, or services. Your use may be subject to their terms.

12. Service changes

We may add, change, suspend, or discontinue features and may correct errors. We do not promise that the Service will always be available, uninterrupted, secure, or error-free. We may provide reasonable notice where a material change adversely affects users.

13. Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTIES. RALLY DOES NOT WARRANT MEMBER IDENTITY OR CONDUCT, COMPATIBILITY, PLAN QUALITY OR SAFETY, CONDITIONS, RESULTS, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. NOTHING IN THESE TERMS EXCLUDES A WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE EXCLUDED.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RALLY AND ITS OPERATOR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF DATA, PROFITS, OPPORTUNITY, REPUTATION, OR GOODWILL; OR HARM ARISING FROM THE INDEPENDENT CONDUCT OF MEMBERS, MEMBER-CREATED PLANS, TRANSPORTATION, VENUES, OR OTHER THIRD PARTIES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RALLY’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF $100 CAD OR THE AMOUNT YOU PAID DIRECTLY TO RALLY DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limitations do not apply to liability that cannot be limited under applicable law.

15. Your responsibility for claims

To the extent permitted by law, you will be responsible for reasonable losses, claims, and costs incurred by Rally resulting from your unlawful conduct, your User Content, your material breach of these Terms, or a plan you create. This does not require you to cover losses caused by Rally’s own unlawful conduct.

16. Suspension, termination, and deletion

You may stop using Rally and delete your account. We may restrict or terminate access where reasonably necessary for safety, legal compliance, misuse, non-payment of a future paid feature, or violation of these Terms. Provisions that logically continue after termination—including ownership, retained licences, liability limits, and dispute provisions—will survive.

17. Governing law and disputes

These Terms are governed by the laws of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law principles. Before filing a claim, please contact support and allow 30 days for an informal resolution attempt. Subject to rights that cannot be waived, disputes will be brought in the courts located in British Columbia.

18. Apple

Apple is not a party to these Terms and is not responsible for the Service, support, maintenance, claims, or content. Your use of the iOS application must comply with the App Store terms. Apple and its subsidiaries are third-party beneficiaries of these Terms to the extent applicable to the iOS application.

19. General

If part of these Terms is unenforceable, the remaining provisions continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with incorporation, financing, reorganization, or a transfer of the Service, subject to applicable law.

20. Changes and contact
